1. Agreement & acceptance

These Terms of Service ("Terms") govern your access to and use of the Kayex Creatives website and services. By using this site or engaging our services you accept these Terms. If you disagree, please do not use the site or contact us for services.

2. Services & proposals

Kayex Creatives offers web design, development, branding, and related digital services. Project scope, deliverables, timeline and fees will be set out in each project proposal or contract. The proposal and any signed contract override any conflicting terms in this document.

3. Client responsibilities

Provide timely feedback, content, and approvals required to complete the project.
Supply any third-party assets (images, logos) with appropriate rights or licences.
Ensure accuracy of information supplied and secure any legal permissions for use of third-party content.

4. Payments & deposits

Payment terms are defined in each proposal. Typically a deposit is required to begin work, and remaining balance is due per the agreed schedule. Deposits are non-refundable once work has commenced.

5. Intellectual property

Kayex Creatives retains ownership of project source files and assets until full payment is received. After final payment, ownership of final deliverables transfers to the client, excluding third-party tools or licensed assets.

      Portfolio & marketing:
      We may showcase non-sensitive project screenshots and descriptions in our portfolio and marketing materials 
      unless a client requests confidentiality in writing.
    

6. Revisions & support

Standard proposals include a limited number of revisions; additional revisions are billed at the agreed hourly or package rate. Maintenance and support beyond the agreed post-launch period is available as a paid retainer.

7. Limitation of liability

To the extent permitted by law, Kayex Creatives will not be liable for indirect, incidental or consequential damages arising from the use of our services or website. Our maximum liability is limited to fees paid for the specific services that gave rise to the claim.

8. Termination

Either party may terminate a project per the contract's termination terms. Kayex Creatives may suspend services where payment is overdue or where client conduct prevents project progress.

9. Governing law

These Terms are governed by the laws of the Federal Republic of Nigeria. Any disputes will be subject to the jurisdiction of the courts in the applicable region.

10. Changes to these Terms

We may modify these Terms at any time. Continued use of the website or services signifies acceptance of the updated Terms.
